Track every state's sales tax nexus threshold before you cross it
Updated · By Ecomsellertool editorial team
To track sales tax economic nexus, total your sales and order counts each month by ship-to state and channel, from Shopify, Amazon, Walmart and wholesale. Then apply each state's own rule: the dollar threshold, any transaction count, the measurement period and whether marketplace sales count. Alert the finance owner at 80% of a threshold, so a person and your tax adviser decide on registration before the obligation starts.
- California counts a seller's marketplace-facilitated sales toward its $500,000 test, measured over the preceding or current calendar year (checked October 30, 2026).
- Texas counts marketplace sales toward its $500,000 safe harbor, measured over the previous 12 calendar months (checked October 30, 2026).
- Pennsylvania counts only sales through a marketplace facilitator that does not collect tax for you, and has no transaction count (checked October 30, 2026).
- New Jersey uses $100,000 or 200 separate transactions in the current or prior calendar year, so order count can trigger first (checked October 30, 2026).
- Shopify's Tax liability insights marks a state Monitoring at 80% of its threshold, but counts only Shopify and imported sales (checked October 30, 2026).
- This recipe only measures and alerts. It files no returns and takes no tax position; a person and your tax adviser decide. Not tax advice.
The step map: who runs each step
Trigger: A monthly schedule after month-end close, plus an on-demand run when a state is already above 80% or a large wholesale order ships to a new state.
| Step | What happens | Who runs it |
|---|---|---|
| 1 | After month-end, rules pull last month's orders from each channel: the Shopify orders export, Amazon's All Orders report, Walmart's Marketplace and WFS payments report, and wholesale invoices from your accounting system. | Rule |
| 2 | Each order is normalized to one row: channel, ship-to state, order date, gross and net amount, refunds, and whether a marketplace facilitator collected the tax on it. | Rule |
| 3 | For each state, rules apply that state's row in the rules table: which channels count, which amount counts, the transaction test, and the measurement window, then compute the running total and count. | Rule |
| 4 | Each state gets a status from its highest ratio against threshold: Clear, Watch at 60%, Alert at 80%, Crossed at 100%, with a projection of the month it would cross at the recent pace. | Rule |
| 5 | Alert and Crossed states go to the finance owner with the channel breakdown, the order rows behind the total and the state page the rule came from. | Rule |
| 6 | The finance owner and the tax adviser decide whether and when to register, collect or file, and record the decision and its date against the state. | Person |
| 7 | Once a quarter a person re-checks each state's rule on its revenue department page and updates the rules table with a new dated row when anything changed. | Person |
5 rule steps · 0 AI model steps · 2 person steps. A rule follows fixed logic you approve; an AI model handles messy input and its output is checked by rules; a person makes the calls listed below.
What stays with a person
- Whether to register in a state, and from which date, decided with your tax adviser
- Which amount counts in each state (gross, net, taxable or all sales) when the state page is unclear
- Each change to the rules table, with the state page and the date it was checked
- How to treat states where you already have physical presence, such as a warehouse, staff or inventory
- Alert levels and who receives them
Which tools can run it
- A spreadsheet with the rules table and one tab per channel export, refreshed by hand each month, for a brand in a few channels
- Zapier, Make or n8n pulling the exports into a sheet or database on a schedule and posting Alert states to Slack or email
- Custom code on your accounts that reads channel APIs and wholesale invoices and keeps 24 months of history per state
Systems it connects
- Shopify
- Amazon Seller Central
- Walmart Seller Center
- QuickBooks Online or Xero (wholesale invoices)
- Google Sheets or a database for the rules table
- Slack or email for alerts

The arithmetic is simple; the work is getting ship-to state and marketplace-collected flags from every channel and keeping each state's rule current.
A brand that sells on Shopify, Amazon, Walmart and to wholesale buyers ships into most US states. Each state with a sales tax decides for itself when a remote seller has to register, and the rules differ in four ways: the dollar amount, whether a number of transactions also counts, the period measured, and whether your marketplace sales are part of the total. Nobody checks all of that by hand every month. This recipe does the counting and tells your finance owner early. It is one page of our automation library.
What does each state's rule look like?
The table below is the core of the tracker: one row per state, every cell read today on that state's own revenue department page. We kept only states where the page we could read states all four parts of the rule, including how a seller's marketplace sales count. New York, Florida, Illinois, Georgia and Ohio are left out for that reason, not because they do not matter; add them once your adviser confirms their marketplace treatment.
| State | Sales threshold | Transaction threshold | Measurement period | Seller's marketplace-facilitated sales count? | Primary source | Checked |
|---|---|---|---|---|---|---|
| California | Over $500,000 of tangible personal property delivered in California, by you and related persons | None stated | Preceding or current calendar year | Yes, they are included | CDTFA Wayfair page and Marketplace Facilitator Act guide | October 30, 2026 |
| Texas | $500,000 of total Texas revenue (safe harbor applies below it) | None stated | Previous 12 calendar months | Yes, since April 1, 2020, even when the marketplace collects the tax | Comptroller remote sellers page and remote sellers FAQ | October 30, 2026 |
| Washington | More than $100,000 of combined gross receipts sourced or attributed to Washington | None stated | Current or prior year | Yes, including sales through a marketplace facilitator | DOR remote sellers page | October 30, 2026 |
| Pennsylvania | $100,000 of annual Pennsylvania gross sales (the page says both "at least" and "greater than") | None ("no transactional count requirement") | Calendar year; prior-year sales set the next collection period | Only sales through a facilitator that does not collect tax for you | Department of Revenue online retailers page | October 30, 2026 |
| New Jersey | Gross revenue over $100,000 | 200 or more separate transactions (either test is enough) | Current or prior calendar year | Yes, a seller on its own website and marketplaces counts both | Division of Taxation remote sellers FAQ | October 30, 2026 |
Two details change what you count. California's Wayfair FAQ says its total may include nontaxable sales, such as sales for resale, so wholesale counts there. Texas defines total Texas revenue as taxable and nontaxable sales into Texas, including sales for resale and separately stated handling, transportation and installation fees. Keep gross amounts, refunds and fees in separate columns so each state's rule can pick the right measure.
Timing matters too. Washington's page says a seller that did not meet the threshold last year starts collecting on the first day of the month that begins at least 30 days after it meets it. Texas says a seller that sells only through a marketplace provider that certifies it collects the tax for the seller does not need a Texas permit. Those are exactly the details the alert should carry to your adviser.
Does Shopify already track this?
Partly. Shopify's Tax liability insights page shows states marked Action required, where potential liability is identified, and Monitoring, where Shopify sales have reached at least 80% of a state's threshold (checked October 30, 2026). It counts net sales, meaning sales less refunds, shipping and tax, from transactions within Shopify and imported orders with a valid shipping address. Marketplace transactions count only where state law requires it, and the page is not available when Shopify manages your US sales tax.
That is a good starting signal for the Shopify channel, and the 80% mark is a sensible alert level. It cannot see Amazon orders, Walmart orders or wholesale invoices that never pass through Shopify. Shopify's own US tax reference also differs from two state pages above today: it lists California marketplace sales as excluded, and Pennsylvania as a twelve-month rolling period with marketplace sales included (checked October 30, 2026). When a tool and the state's page disagree, the tracker follows the state page and flags the difference for your adviser.
What data does each channel provide each month?
| Channel | Report | Fields the tracker uses | Note |
|---|---|---|---|
| Shopify | Orders export (CSV) | Shipping Province, Subtotal, Taxes, Total, Refunded Amount, order date | Up to 50 orders download directly; larger exports are emailed |
| Shopify | Tax liability insights | Status per state (Action required, Monitoring) | Cross-check only; Shopify and imported sales |
| Amazon | All Orders report by order date | ship-state, ship-postal-code, order status, item price | Covers MFN and FBA orders placed in the period |
| Amazon | Sales Tax Report, from the Tax Document Library | Tax detail per order | For tax-enabled US sellers; generated in Seller Central, not requested by API |
| Walmart | Marketplace and WFS payments report | Ship to State, Ship to Zip Code, Fulfillment Type | All order activity in the payment period |
| Walmart | Payments (reconciliation) report | Amount types such as Product tax withheld and Shipping tax withheld | Shows tax Walmart withheld on each order |
| Wholesale | Invoices in QuickBooks Online or Xero, or your B2B order system | Ship-to state, invoice date, amount, resale certificate on file | Include sales for resale where the state counts them |
The sources behind that table: Shopify's orders export columns; Amazon's order report types, which list the All Orders report with ship-state for MFN and FBA, and tax report types, which say the US Sales Tax Report cannot be requested or scheduled and is generated in the Tax Document Library; Walmart's Marketplace and WFS payments report with Ship to State; and Walmart's payments report guide with the withheld-tax amount types (all checked October 30, 2026).
How is the running total calculated?
Every order becomes one row with its channel, ship-to state, date, amounts and a flag for whether a marketplace facilitator collected the tax. For each state, the rules table says which rows count and over which window. Then:
Measured sales (state) = sum of counted amounts shipped to the state inside its measurement window
Ratio (state) = the larger of measured sales ÷ sales threshold and transaction count ÷ transaction threshold
The window follows the state: the current and previous calendar year for California, Washington and New Jersey (alert on whichever is higher), the last 12 calendar months for Texas, and the calendar year for Pennsylvania. The transaction test applies only in states that have one; New Jersey's is an either-or test, so the larger ratio decides.
| Status | Ratio | What happens |
|---|---|---|
| Clear | Under 60% | Shown in the monthly summary only |
| Watch | 60% to 79% | Listed with a projected crossing month at the last three months' pace |
| Alert | 80% to 99% | Sent to the finance owner with the order rows and the state page, for a talk with the tax adviser |
| Crossed | 100% or more | Sent the same day the run finds it, marked for a decision on registration and start date |
The 60% and 80% levels are illustrative starting points; your finance owner sets the real ones. Shopify's own Monitoring status starts at 80%, which is why we use it for Alert.
What does a month's run look like?
An illustrative example, not a client result. A brand sells on Shopify, Amazon and Walmart, and to a few wholesale buyers. In the October run, the tracker shows these measured amounts per state, each under that state's own rule.
| State (illustrative) | Shopify | Amazon | Walmart | Wholesale | Counted total | Ratio | Status |
|---|---|---|---|---|---|---|---|
| Texas, last 12 months | $190,000 | $160,000 | $40,000 | $15,000 | $405,000 | 81% of $500,000 | Alert |
| Washington, current year | $48,000 | $41,000 | $0 | $0 | $89,000 | 89% of $100,000 | Alert |
| California, current year | $180,000 | $150,000 | $30,000 | $20,000 | $380,000 | 76% of $500,000 | Watch |
| Pennsylvania, current year | $62,000 | $30,000 (not counted) | $8,000 (not counted) | $14,000 | $76,000 | 76% of $100,000 | Watch |
| New Jersey, current year | 140 orders, $21,000 | 90 orders, $9,000 | $0 | 3 invoices, $15,000 | 233 transactions, $45,000 | 117% of 200 transactions | Crossed |
Two rows show why the rules table matters. In Pennsylvania the marketplace collected the tax on the Amazon and Walmart sales, so they are left out; counting them would show $114,000 and a false Crossed. In New Jersey the dollar total is only 45% of $100,000, but 233 separate transactions pass the 200 test. A tracker that only watched dollars would miss it. The finance owner gets three alerts with the rows behind them and takes them to the tax adviser.
Where does it sit next to your other finance workflows?
The tracker reuses data other workflows already move. Our marketplace payouts to QuickBooks and Xero recipe books the tax a marketplace collected into a clearing account; the same order rows tell this tracker which sales a facilitator handled. Our daily sales report to Slack already pulls orders from every channel each morning, so adding ship-to state to that pull feeds the monthly run. For wholesale, our wholesale customer application queue collects resale certificates, which matter for how a sale is taxed even when it still counts toward a threshold.
The merchant of record glossary entry explains that marketplace facilitator laws cover only sales made through the marketplace, not sales on your own website or to wholesale buyers. The tracker exists for that gap.
Which tool should run it?
| Level | Fits when | What to watch |
|---|---|---|
| A spreadsheet with the rules table and channel exports | A few channels, a few thousand orders a month | Someone must load every export after month-end; rule changes are easy to miss |
| Zapier, Make or n8n with a sheet or database | Exports on a schedule, alerts to Slack or email | Large monthly exports can hit task limits; keep 24 months of rows somewhere other than the automation tool |
| Custom code on your accounts | Several marketplaces, wholesale, many states, an audit trail of rule changes | Can run on Ecomsellertool Growth OS beside your order data |
Our Zapier vs Make vs n8n comparison covers how each tool counts work.
Who builds sales tax nexus trackers?
Ecomsellertool builds workflow automation on your own store, marketplace and accounting accounts; we have built software on Amazon's seller APIs since 2017. For a nexus tracker we write the rules table and alert levels with your finance owner first, then connect each channel's order data and the alerts. Your tax adviser keeps every tax decision. Send a project brief, or see how our workflow automation service works.
The building blocks are work we have shipped:
- One view of orders across channels. For Beezboard we built a profit and loss statement tailored to specific marketplaces, and an orders view from Amazon SP-API report data covering both Amazon and non-Amazon channels, with Amazon SQS used for faster updates on order activity and fee changes.
- Merging reports into period totals. For Lavley we identified the reports needed, merged data from several Amazon sources, and built analytics by brand, ASIN, year, quarter, month and week, the same period roll-ups a nexus window needs.

Frequently asked questions
How do I know if I have sales tax nexus in a state?
Physical presence, such as an office, staff or inventory, can create nexus. For remote sellers, most states also use an economic test: sales, and in some states a number of transactions, into the state over a set period. Check each state's revenue department page for its test and confirm your position with a tax adviser.
Do Amazon and Walmart sales count toward my economic nexus threshold?
It depends on the state. On their own pages, California, Texas and Washington count a seller's marketplace sales toward the threshold, while Pennsylvania counts only sales through a marketplace that does not collect the tax for you. Read each state's page rather than assuming one rule fits all.
What is the economic nexus threshold in Texas?
The Texas Comptroller says a remote seller whose total Texas revenue is less than $500,000 in the previous 12 calendar months is not required to hold a permit. Total Texas revenue includes taxable and nontaxable sales and sales for resale, and since April 1, 2020 it includes marketplace sales.
Does Shopify track sales tax nexus for me?
Partly. Shopify's Tax liability insights page shows states that need action and marks a state Monitoring at 80% of its threshold, but it counts Shopify sales and imported orders, not your marketplace or wholesale sales outside Shopify, and it is not available when Shopify manages your US sales tax.
What should happen when a state crosses the threshold?
Nothing automatic. The tracker tells the finance owner, with the numbers behind it. The finance owner and your tax adviser decide whether to register, when collection should start under that state's rules, and how to handle marketplace sales. This recipe never registers, files or remits for you.
Is a transaction-count threshold still used?
Some states still use one and some never did. New Jersey's page lists 200 or more separate transactions as an alternative to $100,000, while Texas, Washington and Pennsylvania use a sales amount only. Keep the transaction count as its own column so a state's rule can switch it on or off.
